Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of BidPilot (the "Service"), operated by Muhammad Ahtisham, an individual developer based in Pakistan ("we," "us," "our"). By creating an account, connecting an Amazon Advertising profile, or otherwise using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

2. The Service

BidPilot is an automated bid optimization platform for Amazon Sponsored Products campaigns. It allows you to:

  • Connect one or more Amazon Advertising profiles via Login with Amazon
  • Build custom optimization rules using a visual IF/THEN rule builder
  • Automatically execute those rules on a schedule you define
  • Review and approve bid changes before they are applied to your Amazon account (for changes above a configurable threshold)
  • View historical bid performance and audit logs

3. Eligibility

To use BidPilot, you must:

  • Be at least 18 years old, or the legal age of majority in your jurisdiction
  • Have the legal authority to enter into this agreement
  • Either own the Amazon Seller / Vendor Central account(s) you connect, OR have explicit written permission from the account owner to access and modify their advertising settings on their behalf
  • Comply with all applicable laws and Amazon's own terms of service

Agency use: If you are using BidPilot to manage advertising for clients, you represent and warrant that you have been duly authorized by each client to access and modify their Amazon advertising on their behalf. You are solely responsible for maintaining that authorization.

4. Your Account

4.1 Account Creation

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account.

4.2 Account Security

Notify us immediately at ahtishampatni653@gmail.com of any unauthorized use of your account or any other security breach. BidPilot is not liable for any loss or damage arising from your failure to protect your credentials.

4.3 Account Termination

You may terminate your account at any time from the account settings page. We may suspend or terminate your account if we believe you have violated these Terms, Amazon's API License Agreement, or applicable law. Upon termination, your data will be deleted in accordance with our Privacy Policy.

5. Acceptable Use

You agree NOT to use BidPilot to:

  • Access any Amazon account without proper authorization from its owner
  • Violate Amazon's Advertising API License Agreement, rate limits, or any other Amazon policies
  • Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service
  • Use automated scripts, bots, or scrapers to abuse, overload, or interfere with the Service
  • Attempt to gain unauthorized access to other users' accounts or data
  • Upload, store, or transmit any viruses, malware, or malicious code
  • Use the Service for any illegal, fraudulent, or harmful purpose
  • Resell, sublicense, or otherwise commercialize access to the Service without our written permission

6. Amazon Integration — Your Responsibility

IMPORTANT: Please read this section carefully.

BidPilot is a tool that applies bid changes to your Amazon Advertising account based on rules YOU define. You are in full control of, and solely responsible for:

  • The rules you create and the formulas they use
  • The bid ranges (floor, ceiling, maximum change) you configure
  • The schedule on which rules run
  • Whether changes apply automatically or require approval
  • Reviewing and approving any bid changes that fall outside your auto-apply threshold
  • The financial outcomes — positive or negative — of the bid changes BidPilot applies on your behalf

BidPilot provides safety features (rule simulation, approval queues, bid floors and ceilings, maximum change limits, audit logs) to help you use the Service responsibly. It is your responsibility to use these features appropriately.

7. No Financial Advice

BidPilot is a software tool, not a financial, advertising, or business advisor. Nothing in the Service constitutes financial, legal, tax, or professional advice. You should consult qualified professionals before making business decisions that depend on BidPilot's outputs.

8. Beta Service

BidPilot is currently in private beta. During the beta period:

  • The Service is provided "as is" with no guarantees of uptime, stability, or feature completeness
  • Features may be added, changed, or removed without notice
  • Data loss, while unlikely, is possible
  • You acknowledge that you are using pre-release software at your own risk

9. Fees and Pricing

During the private beta, BidPilot is provided free of charge to selected early-access agencies. We reserve the right to introduce paid plans in the future. Beta users who participate during this period will receive preferential pricing when paid plans launch — we will notify you at least 30 days before any billing changes take effect, giving you time to decide whether to continue or export your data.

10. Intellectual Property

BidPilot, including its software, design, logos, and documentation, is owned by Muhammad Ahtisham and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose.

Your data (rules, performance data, bid history) belongs to you. We only use it to operate the Service for you, as described in the Privacy Policy.

11. Third-Party Services

BidPilot integrates with the Amazon Advertising API and other third-party services (Supabase for database, Vercel for hosting). Your use of those services is subject to their own terms of service. We are not responsible for the availability, functionality, or data handling of third-party services.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • BidPilot's bid optimization will improve your advertising performance or return on ad spend

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MUHAMMAD AHTISHAM OR BIDPILOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of advertising revenue, sales, or profits
  • Overspend on Amazon advertising due to misconfigured rules
  • Loss of ad campaigns, keywords, or historical performance data
  • Business interruption
  • Loss of goodwill or reputation

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Muhammad Ahtisham and BidPilot from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of Amazon's terms, policies, or API License Agreement
  • Your violation of any third party's rights, including intellectual property or privacy rights
  • Any bid changes that BidPilot applies to an Amazon account on your behalf

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved through good-faith negotiation first; if that fails, disputes shall be submitted to the courts of Pakistan.

16. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email to registered users at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BidPilot regarding the Service. They supersede any prior agreements, proposals, or communications, written or oral.
